Defendant shall be punished by a fine of 1.5 million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
1. On February 24, 2018, at a luminous terminal located in Gwangju-gu, Seo-gu, Gwangju, the Defendant: (a) obtained pecuniary benefits equivalent to the amount of money by deceiving the victim by entering his/her phone number in the settlement machine attached to a taxi in spite of the fact that there is no cash available in the number and there is no balance in the transportation card; and (b) printing a receipt for cash by dividing the cash receipt into the cash receipt issuance box; and (c) removing the payment of KRW 33,000 from the victim B to the payment of KRW 33,00.
2. On February 24, 2018, the Defendant arrived at a State terminal located in Naju-si on February 24, 2018, and would pay taxi charges in advance to the said victim B, “I wish to go back to Gwangju-si after completing work. I want to move back to Gwangju-si.”
“After waiting for the victim,” the victim was released from payment of KRW 31,00 of the taxi fee from the victim B by entering his phone number in the settlement period attached to the taxi, and printing a cash receipt by printing out the cash receipt, even though there is no cash in fact and there is no intention or ability to pay the taxi fee due to the absence of the balance of the transportation card.
3. On February 24, 2018, the Defendant: (a) taken a taxi for business use by the said victim B at a main terminal located in the city of Naju on February 24, 2018; (b) went through the e-mail announcement in the Dong-dong located in the Gwangju Mine-gu, Gwangju; (c) Notwithstanding that there is no cash in fact and there is no difference in the transportation card and there is no intention or ability to pay taxi charges, the Defendant deceivings the victim by entering his/her phone number in the settlement machine attached to the taxi; and (d) dividing the cash receipt issuance pressing into the cash receipt issuance server and printing out the cash receipt.
