The defendant shall publicly announce the summary of the judgment against the defendant not guilty.
Reasons
1. On February 28, 2019, the Defendant: (a) boarded a taxi for business use (number non) around 02:00 on February 28, 2019; (b) moved approximately KRW 2.9km from the name of the Daegu-gu Nam-gu to the youth training center located in Daegu-gu, Daegu-gu, the Defendant did not pay the taxi fee without justifiable grounds.
2. After having arrived at the destination at the time of the instant case, the Defendant’s gist of the Defendant’s assertion: (a) placed a person with disabilities in the issuance of B Bank’s cream card (Concurrent use of transportation cards) in order to pay KRW 3,400 to the taxi fares; and (b) requested the Defendant to pay the taxi fares in cash to the taxi driver, who did not settle the payment with the taxi terminal installed in the taxi.
Therefore, if the defendant has no cash, the defendant asked to transfer the taxi fee later, and the taxi driver refused to offer his/her proposal and immediately reported his/her free-on lane by driving the taxi according to the adjacent C district.
At first, the police officer in charge of the C District shall inform the defendant of the telephone number of the defendant's father or his father's phone number, but the defendant shall not be informed his father of whether he would be able to hear from his father, and he controlled the defendant as a violation of the Punishment of Minor Offenses Act.
Since the Defendant intentionally did not board a taxi from the beginning, and there exist justifiable grounds for not paying a taxi fee at the time, the instant facts charged cannot be recognized.
3. In full view of all the circumstances, including the health stand and the witness D’s legal statement, who is a police officer at the time, as to the instant case, the Defendant attempted to pay the taxi fare later by account transfer, etc. at the destination of the instant case, if he did not settle the taxi card due to the problem of the taxi terminal, etc. at the time of the instant case, but thereafter, the following situation is not significant.
