Reasons
Punishment of the crime
The Defendant died on October 8, 2017 and was de facto in a de facto marital relationship from around 2011, and C is the spouse, D, and E under the deceased B’s law.
After the death of B, the Defendant used two passbooks of the F Bank of the Deceased, his seal impression books, G Bank Cze Card, etc. to use at will deposits deposited in the passbook without the consent of the above inheritors.
1. Forging a private document;
A. On October 12, 2017, the Defendant entered “H” and “50,000,519 won” in the account number column using a scriptive package in the written request for withdrawal of deposit, and entered Defendant’s bank account number in the column of the deposit bank, and affixed “B” in the name column of the transferor, and affixed a seal impression on the network B in possession of the name.
Accordingly, for the purpose of uttering, the Defendant forged a request for withdrawal of deposit in the name of B, a private document related to rights and obligations.
B. The Defendant stated “I,” “B,” 12,905,681 won in the Account Number column in the foregoing request for withdrawal of deposit at the same time and place, and indicated the Defendant’s bank account number in the column of the deposited bank, and signed “B” in the column of the name of the transferor and affixed a seal imprint of the network B in possession of that name.
Accordingly, for the purpose of uttering, the Defendant forged a request for withdrawal of deposit in the name of B, a private document related to rights and obligations.
2. The Defendant, at the above date, at the above time and place, submitted two copies of the written request for withdrawal of forged deposits to the staff in charge of the unfash bank counter who was aware of the forgery.
3. The Defendant, at the above date and time, requested the transfer of deposits in two copies of the written request for withdrawal of deposits in the name of the network B, which was forged as above, to the employees of the victim F Bank.
However, in fact, B of the head of the Tong has already died.
