The appeal shall be dismissed.

The costs of appeal shall be borne by the defendant.

The records of this case, the original judgment, and the grounds for appeal were examined. However, the grounds for appeal by the appellant do not include the grounds prescribed in each subparagraph of Article 4(1) of the Act on Special Cases Concerning the Procedure for Appeal, or it is recognized that the grounds for appeal by the appellant are groundless. Accordingly, the appeal shall be dismissed pursuant to Article 5 of the same Act and the costs of appeal shall be borne by the losing party. It is so decided as per Disposition by the assent of all participating Justices.
