Reasons
Punishment of the crime
[2015 Highest 765]
1. Night-time theft of buildings;
A. At around 01:20 on February 10, 2015, the Defendant: (a) opened a window side of the above gas station office using the said window in a way that the victim D operated in Daegu-dong-gu E-dong-gu (U.S.); (b) went into the said office by hand and intrudes into the said office; and (c) stolen KRW 38,000 in cash owned by the victim D and KRW 30,000 in cash owned by the victim D located in the said office; and (d) committed theft with the said cash owned by the victim D in the air conditioners.
B. At around 02:30 on February 11, 2015, the Defendant: (a) entered a restaurant through the lower window of the above restaurant, where the victim G operation in Busan City F, via which the nearby surveillance was neglected, and stolen KRW 40,000, cash, which was cash owned by the victim G in the restaurant, was located in the restaurant.
2. Attempted special larceny;
A. On February 10, 2015, around 02:11, 2015, the Defendant: (a) took advantage of the enormous amount of aluminium in the instant gas station in the Korea Gas Agency operated by the victim J, Daegu-gu, Daegu-gu, and damaged the devices to correct the windows of the said gas station office by attaching the devices to the above gas station; (b) entered the said office through the said window, opened in the guard company’s emergency bell and opened the said equipment and carried the money and valuables in the guard company’s office; and (c) went through the said window and escaped, the Defendant did not commit an attempted crime by getting out of the said window.
B. On February 11, 2015, at around 00:06, the Defendant: (a) committed an attempted act by leaving the above office through the above window, following the Defendant’s imprisonment without prison labor, correspondence, etc. in the above office; (b) but (c) failed to discover money and other valuables and escape through the window; and (d) failed to commit an attempted act.
