1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. From June 15, 1984 to September 1, 1990, the Plaintiff is an employee who engaged in dusty work in a limited partnership company for new industrial development. On April 10, 2014, the Plaintiff filed an application for medical care benefits for pneumoconiosis with the Defendant after receiving a precise diagnosis of pneumoconiosis at Boansan Hospital.

B. On June 2, 2014, the Defendant issued a site pay disposition for pneumoconiosis insurance benefits (hereinafter “instant disposition”) to the Plaintiff based on the determination that “the pneumoconiosis-type circumstances (0/0) and cardiopulmonary function (F0)” were “the normal conditions (F0)” following a close diagnosis against the Plaintiff.

2. Whether the instant disposition is lawful

A. According to the precise diagnosis conducted by the Bosia Hospital as a pneumoconiosis worker, the Plaintiff’s assertion constitutes class 13 of the pneumoconiosis disability grade since the pneumoconiosis type is 1/0 type and cardiopulmonary function is normal (F0). However, the instant disposition made on a different premise is unlawful.

C. (i) From April 1, 2004 to February 24, 2014, the results of the precise diagnosis conducted six times: both of the results of the precise diagnosis: C/0; (ii) normal determination of C/O; and (iii) P/O of Bolian Hospital on April 10, 2014; (q/q: 1/q: 1/0; (q) location: 1/0: RU, RU, LU, LM, FE1/FC 73% - the Council for Deliberation on Pneumoconiosis - the normal (0/0); normal (0) - the results of the examination of medical records conducted at the National University of Korea; and (iv) the results of the examination of medical records conducted at the National University of Korea; and (iv) the results of the examination conducted at the National University of Bolian; and (v) the results of the examination conducted by the National Assembly of M/M Malian C/FV1/FC 73%; and (v) the detailed image of the meo image.

- The Plaintiff’s chest X images show a view to be dissatisfed in both sides, and do not show a big change in the chest X images taken on February 24, 2014, and April 8, 2014.
