1. Details of the disposition;

A. The plaintiff (1937) filed an application for medical care for pneumoconiosis with the defendant as a worker who was engaged in dusty work in the mine mine of Sungju Mining Corporation.

B. From June 11, 2013, the Defendant

6. Until December 13, 199, the Boan Hospital conducted a precise diagnosis of pneumoconiosis with the Plaintiff.

C. On January 7, 2014, the Defendant issued a disposition to pay pneumoconiosis insurance benefits installment (hereinafter “instant disposition”) against the Plaintiff on the ground that the Plaintiff’s pneumoconiosis type falls under normal conditions (0/0), pulmonary species, and non-activity-pulmonary tuberculosis.

2. Whether the instant disposition is lawful

A. Since the Yania Hospital which conducted a precise diagnosis of pneumoconiosis with the Plaintiff’s assertion, diagnosed the Plaintiff’s pneumoconiosis type 1, the Defendant should determine the Plaintiff’s pneumoconiosis type 1 and pay the Plaintiff the pneumoconiosis medical care benefits.

C. (1) As a result of the close diagnosis four times from November 18, 2009 to May 7, 2013, the Plaintiff’s pneumoconiosis type was determined as normal (0/0).
