Reasons
Punishment of the crime
On May 20, 2020, the Defendant was sentenced to one year of imprisonment for fraud, etc. at the Seoul Western District Court on May 20, 202 and the judgment became final and conclusive on June 10, 2020.
The Defendant, upon receiving a proposal from the singing staff to pay 2% of the amount of half the amount of cash as an allowance when transporting cash from the singing staff, consented to the proposal, and conspired to participate in the singing crime by receiving cash from the singing staff deceiving the said staff, and delivering the cash again to the said staff.
On December 13, 2019, the employee of the U.S. T-S. T-S. T-S. T-S. T-S. S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S.
To be issued a Maspbook, the false statement was made that “If C bank employees visit the house at home, the cash will be delivered to the employee.”
However, the above members were not C Bank employees, and even if they received money, they did not have the intent or ability to issue the Maspbook to the victim or return the money again to the victim.
At around 11:40 on the same day, the Defendant visited the victim’s residence in Gwangjin-gu Seoul Special Metropolitan City, and was prepared to deliver KRW 20 million in cash at the end of the aforementioned false statement, and received cash KRW 20 million from the victim as C bank employees. Of which, 40,000 won, the Defendant himself/herself and delivered the remaining cash to the victim under the direction of Bosing staff.
Accordingly, the defendant received property from the injured party in collusion with his or her nameless singing staff.
