Reasons
Punishment of the crime
The defendant thought that he received a loan in the name of B without permission of B with the fact that he kept his personal information, cell phone, and authorized certificate as a space living together with B.
1. Alteration and use of private electronic records, etc.;
A. On September 23, 2014, the Defendant applied for a loan to D in the name of B by accessing the Internet homepage of DB, which had been living with the Chungcheongnam-si, Chungcheongnam-si, the first and the first floor, and sent it to D Co., Ltd. by means of a digital certificate of C, which was kept after entering the said residence into “E” and “B” in the name column of the loan transaction agreement in the name column of 3,000,000 won. The Defendant sent it to D Co., Ltd. by means of storing and entering the said company’s website.
Accordingly, the Defendant forged and exercised a file of a loan transaction contract, which is an electronic record in B’s name on rights and duties, for the purpose of making administrative affairs smooth.
B. On October 7, 2014, the Defendant, at the same location as the above paragraph (a) and applied for a loan to the FB Bank in the name of the FF Bank in the name of B by accessing the Internet website, signed with the “E” and the “B” certificate, which was kept after entering the said residence in the “B” and the “B” resident number column, and sent it to the employees of the FF Bank Resolution by means of storing and entering the said company’s website.
Accordingly, the Defendant forged and exercised a file of a loan transaction contract, which is an electronic record in B’s name on rights and duties, for the purpose of making administrative affairs smooth.
C. On August 8, 2016, the Defendant applied for a loan of KRW 12,00,000 in the name column of the loan transaction agreement with the Internet homepage of the Credit Business Company D in the name of DB by accessing the Internet homepage of DB by using the computer at the same location as the above paragraph (a).
