피고인은 2013. 4. 16. 19:56경 피해자 F의 휴대전화에 "너 이년 까불다가 깡냉이 다 뽑아분다 ㅋㅋㅋ 좆못빨면 어쩔래 이년아 ㅎㅎ 윗몸으로 빨래 ㅎ”라는 문자메시지를 보낸 것을 비롯하여 그때부터 2013. 6. 4. 07:29경까지 별지 범죄일람표 기재와 같이 158회에 걸쳐 피해자에게 문자메시지를 보냄으로써 정보통신망을 통하여 공포심이나 불안감을 유발하는 문언을 반복적으로 피해자에게 도달하게 하였다.
