A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. Night-time theft of buildings;

가. 피고인은 2014. 7. 24. 04:10경 인천 계양구 C에 있는 피해자 D이 운영하는 E마트 앞 길에 이르러 진열된 상품을 차단하고 있는 천막을 연 후 위 마트에 침입하여 피해자 소유인 시가 합계 2만 원 상당의 스낵면 1박스, 음료수 6개, 과자 3봉지, 빵 3봉지를 가지고 가 절취하였다.

나. 피고인은 2014. 8. 16. 03:28경 위 마트에 가항 기재와 같은 방법으로 침입하여 피해자 소유인 시가 합계 2만 원 상당의 스낵면 1박스, 음료수 6개를 가지고 가 절취하였다.
