A defendant shall be punished by imprisonment for four years.

Punishment of the crime

On December 28, 2006, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at Busan District Court on December 28, 2006, and completed the execution of the sentence on April 5, 2007.

Even if the Defendant is not a person handling narcotics, the Defendant imported and sold psychotropic drugs-related Mespons (one philopon, hereinafter “philopon”) as follows:

1. On January 4, 2008, the Defendant: (a) sent C the 111,200 won (Korean approximately KRW 15,000,000) of Chinese money to C upon the request of C to seek writingphones from the Chinese heart at the Chinese depth.

C around that time, at the multi-party coffee shop in the Chinese heart, requested D to seek the philophones by suggesting that D purchase price for the above philophones received from the Defendant, at the same time D and E.

C) After receiving D’s instructions from E to monitor about 19 Korean computers with approximately 287.4g of phiphonephones, and entered them into “F, Busan Metropolitan City G buildings, and H” as designated by the Defendant in the International Postal Transport Schedule, and then sent to Korea a computer monitor with concealed phiphones using international mail special cargo in Chinese depth around January 22, 2008.

After that, at around 11:35 on January 23, 2008, the aircraft of 681, South China, which is loaded with a computer monitor which is concealed the said phiphone, was arrived at the Incheon Central Government Provision port located in Jung-gu Incheon, Jung-gu, Incheon, and the above phiphone was brought into the ground.

Accordingly, the Defendant imported approximately 287.4 grams in collusion with C, E, and D.

2. On April 13, 2009, the Defendant: (a) around 23:40 on the part of the Busan Southern-gu Office in Busan-gu, Busan-gu; (b) around 90,000 won from J upon the I’s request of the Busan Southern-gu Office, which received a delivery of the phi-phone; and (c) sold approximately 0.6g of phi-phones contained in the plastic paper in the plastic paper of a cigarette to J.
