1. Of the Plaintiff’s lawsuits against Defendant Kook Global Corporation, KRW 731,816,320 among the lawsuits and KRW 100,000,100 among them.
Reasons
1. The following facts may be found either in dispute between the parties or in full view of Gap evidence Nos. 1, 2, 3, 5 through 12 (including each number; hereinafter the same shall apply), Eul evidence Nos. 1, Eul evidence appraisal result, each supplementary appraisal result, each supplementary appraisal result, and the whole purport of the pleadings.
The plaintiff is the council of occupants' representatives comprised of the occupants in order to manage the 11-dong A Apartment-gu in Ansan-si (hereinafter referred to as the "the apartment of this case").
C A reconstruction association (hereinafter referred to as “non-party reconstruction association”) is a project proprietor who constructed and sold the apartment of this case, and the original trade name of Defendant Culul Global Corporation (Defendant Culul Global Corporation was “Coul Global Corporation,” and the trade name was changed on December 30, 201 to “Coul Global Corporation; hereinafter “Defendant Culul Global”) was made on October 26, 2007.
B. Defendant Culul Global entered into each contract for the warranty of defects as indicated below (hereinafter “each of the instant warranty contracts”) with the Defendant Construction Mutual Aid Association and the Defendant Construction Mutual Aid Association on the apartment of this case with the guarantee creditor as the open market, and received each of the warranty bonds from the Defendant Construction Mutual Aid Association.
