A defendant shall be punished by imprisonment for two years.

However, the above sentence shall be executed against the defendant for three years from the date of the final judgment.

Punishment of the crime

Despite the fact that the Defendant is not a person handling narcotics, the Defendant treated the marijuana as follows:

1. The Defendant sold marijuana along with a name-free box (the name-free box C; hereinafter the same shall apply) known through the Dac Web B, and C supplied the Defendant with marijuana, and the Defendant conspireded to give the Defendant with the name-free purchaser who reported and contacted the advertisement of marijuana sales posted in C, and to exchange conversations related to the price of marijuana sales and the area of marijuana sales, and to inform the buyer of the location of the advertisement.

On March 17, 2019, the Defendant decided to sell approximately five grams of marijuana to a purchaser on his name, who reported and contacted the advertisement for the sale of narcotics posted by the said C. On March 17, 2019, the Defendant sent 0.057 bitcos (BTC) from the said purchaser the purchase price for marijuana to the said purchaser, and concealed about five grams of marijuana to the foregoing purchaser at a non-commercial area of Gangnam-gu Seoul Metropolitan Government. The Defendant informed the purchaser of his address so that he can recover it.

As above, the Defendant, in collusion with C, sold about 5 grams to the buyers in name in collusion with C, and sold approximately 650 grams of marijuana to the buyers in name in 52 times from the above date to April 9, 2019, as indicated in the list of crimes in the attached Table, 10.07015 bitco (BTC).

2. On March 19, 2019, the Defendant, who attempted to sell marijuana, agreed to sell approximately 5.09g of marijuana to D, which reported and contacted advertisements posted by C, and received from D, 0.0672 bitcos (BTC) from D, with the electronic wallets used by the Defendant.

The Defendant concealed approximately 5.09g of marijuana on the back side of the air conditioner in Seocho-gu Seoul, Seocho-gu, Seoul, and informed the address so that D can find it. However, the Defendant is arrested to the police due to the suspicion of the purchase of marijuana.
