A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant, in a situation where the South-dong Office could not receive land from B and C, refers to the fact that the Defendant would receive land from the South-dong Office, and received money from related expenses for the implementation of the agreement, and was urged to do so, the Defendant forged the deposit confirmation certificate under the name of the head of the South-dong Office in order to pretend that the procedure related thereto is underway, and sentenced to deliver it to him.

가. 공문서위조 피고인은 2019. 4. 9.경 인천 남동구 만수동에 있는 상호불상의 명함인쇄소에서, 그 정을 모르는 그곳 직원으로 하여금 컴퓨터 워드프로세서를 이용하여 ‘예치금 확인증’이라는 제목으로, 금액란에 ‘一金 壹仟六百五十萬整(16,500,000원)’, 내용란에 ‘상기 금액은 남동구 D 소재 구유지 328평 예치일로부터 1년 후 공시지가로 불하받는 조건으로 아래와 같이 명시된 분에게 우선으로 불하받는 권리를 준다. 상기 금액은 본청에서 보관 후 불하를 받지 못할 시에는 위 금액을 본인에게 되돌려 준다.’, 주소란에 ‘서울시 영등포구 E건물 F호’, 성명란에 ‘B(G)’, 날짜란에 ‘2019-4-9’, 담당자란에 ‘H팀 I’, 발행인란에 '남동구청장' 이라고 각각 기재하게 한 후, 이를 그곳 프린터로 인쇄한 다음 미리 임의로 새겨서 소지하고 있던 남동구청장의 직인을 임의로 날인하였다.

Accordingly, for the purpose of uttering, the Defendant forged a certificate of deposit against B under the name of the head of South Dong-dong, a public document.

B. On April 9, 2019, the Defendant: (a) at a fishing place operated by K located in the Nam-gu Incheon Metropolitan CityJ, the Defendant: (b) asked K to deliver the forged facts to the said B; (c) held that one copy of the certificate of deposit, which is a forged official document, was issued as if it were genuine.
