Defendant shall be punished by a fine of KRW 1,000,000.
If the defendant does not pay the above fine, 50,000 won shall be paid.
Reasons
Punishment of the crime
The Defendant is the representative director of C Co., Ltd. (hereinafter “Company”) and owned 6,000 shares of the above Company D and SP, who are his wife, respectively. The total number of shares issued by the above Company was 20,000 shares.
1. On January 20, 2012, the Defendant, within the office of the pertinent company located in Songpa-gu Seoul Metropolitan Government F 202, had D, without authority, enter D in the share acquisition agreement the name column of the transferor (D, G, and address column “D, 213 Dong-dong 503, 503,” and in the name column of the transferee (B), “I, J, and address column” in the name column of Gangdong-gu Seoul H apartment 213 Dong-dong 503, 103-604, 3,000 shares in the shares type column, “C common shares,” “10,000 shares,” “1,00 shares transfer value per share,” “1,00 shares transfer value per share”, “1,000”, and “D” and “1,000” on the date column, with the name of the transferor(s) and “A” attached the name of the transferee(s) and obligations of the transferee(s).
2. At the time and place indicated in the preceding paragraph, the Defendant, without authority, had L, who is an accounting employee, enter the name column of the transferor (E, M, and address column in the name column of the transferor (Seoul-gu N), i, J, and 103-604 in the name column of the transferor (A), i, J, and address column 103-604, c common shares in the shares type column, i, “6,000 shares in the shares transfer column,” i, “10,000 shares in the shares transfer column,” i, “10,000 shares in the face value per share,” 1,00 shares transfer value per share, i, “1,00 shares transfer value per share,” i, “6,00 shares in the shares transfer form and quantity column,” and ii, with the name “D” and i’s name and duties attached to the transferor(A) column, i.e., the transferee(s) column.
3. The Defendant, around January 22, 2012, shall have D as above, at the same place as that described in paragraph (1).
