A defendant shall be punished by imprisonment for one year.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, along with the victim C, is a person who has been engaged in cargo transportation services with the mutual name of “E Co., Ltd. (hereinafter “E Co., Ltd.”) on the first floor of the Young-gu D Building Do, Suwon-si.

The Defendant, as the representative director, prepared a false share transfer and takeover contract to transfer all of the shares of the instant company that the said C had held 100% (20,000 shares) to the Defendant and the F who left a vehicle to the said company, and used it to dismiss the said C from the office of representative director and to take office as the representative director of the said company.

1. Forgery of private documents;

A. On March 1, 2011, the Defendant: (a) around March 1, 201, using the pen-type in the form of a stock transfer contract, the quantity, transferor, and transferee of the shares at the instant company’s office; (b) “E”; (c) “8,000 shares in the quantity column; and (d) “A1,3, and1” in the total amount column; (c) “C” in the transferor column; and (d) “G” in the resident registration number column; and (c) “A” in the address column of the Seoul Special Metropolitan City Jung-gu Seoul Metropolitan City Office; and (c) “A” in the resident registration number column; and (d) “I” in the address column; and (d) Gyeonggi-do J apartment 319-1904, each of which was prepared after entering the “A” as the address column, the complainant’s personal seal impression was affixed next to the name of the transferor C.

Accordingly, for the purpose of uttering, the Defendant forged one copy of the share transfer contract under C, which is a private document on rights and obligations.

B. On March 1, 2011, the Defendant: (a) around March 1, 201, at the office of the said stock company, the amount of shares transfer, transferor, and transferee column using a pen-type in the form of a stock transfer contract in blank; (b) “E”; (c) “6,000 shares in the quantity column”; and (d) “C,1,3, and1” in the total amount column; (b) “C” in the transferor column; (c) “G” in the resident registration number column; and (d) in the address column, “K and its address column”.
