The defendant.

1. Basic facts

A. On March 9, 2010, the Plaintiff engaged in the manufacturing business of metal structures, etc. under the trade name of “C” entered into a contract with the Defendant, who is engaged in the business of manufacturing and selling food products, to manufacture and supply 83,000,000 won for an automatic supply machine (hereinafter “first facility”) in return for neglect to the Defendant.

The Defendant paid KRW 80,00,000 to the Plaintiff as the first facility cost from March 9, 2010 to September 30, 2010, as stated in the attached deposit Nos. 1 to 7 and 9.

B. Around June 8, 2010, the Plaintiff supplied the Defendant with one unit of an automatic gas supply machine (hereinafter “second unit facility”) with a price of KRW 20,000,000 (excluding value-added tax).

The defendant paid 20,000,000 won in total as the secondary facility cost, such as the attached deposit Nos. 10 and 11.

C. On October 22, 2010, the Plaintiff and the Defendant made a contract for manufacturing equipment supply and installation (hereinafter “third facility supply contract”) with the content of supplying and installing the Defendant’s factory, and the Defendant paid to the Plaintiff KRW 80,000,000 of the down payment (excluding value added tax) out of KRW 792,00,000 (excluding value added tax) as shown in attached Form 8.

The main contents of the third facility supply contract are as follows:
