피고인은 2013. 6. 7. 10:27경 천안시 서북구 B 405호(C) 주거지에서 주식회사 퍼스트미디어에서 제공하는 인터넷 파일 공유사이트 ‘조이파일’ (www.joyfile.co.kr)에 ’D’이라는 아이디로 접속하여 ‘성인’ 카테고리 게시판에 ‘[쪼리퐁] 마사지-쿡산 여자 마사지 대화내용 굿’(게시물번호 6114106)이라는 제목으로 여성이 남성의 성기를 입으로 빠는 장면, 남ㆍ여가 성관계하는 장면 등의 음란한 영상을 공공연하게 배포ㆍ전시하였고, 이와 같은 방법으로 그때부터 2013. 9. 6. 20:54경까지 별지 범죄 일람표와 같이 일반인의 정상적인 성적 수치심과 선량한 성적 도의적 관념에 반하는 음란한 영상 256편을 불특정 다수인이 내려 받을 수 있도록 공공연하게 배포ㆍ전시하여 적립한 마일리지로 17회에 걸쳐 도합 1,054,700원 상당을 피고인 명의 농협 계좌 E로 환전 받는 방법으로 음란한 영상을 판매하였다.
