The judgment of the court below is reversed.

1. Summary of grounds for appeal;

A. The facts charged in this case by misapprehending the legal principles are that the defendant has res judicata effect on the above final summary order in relation to the facts charged in the summary order which became final and conclusive, and thus, a judgment of acquittal should be rendered against the defendant. However, the court below convicted the defendant by misunderstanding the legal principles.

B. The sentence (one million won of fine) imposed by the court below on the defendant is too unreasonable.

2. Determination

가. 공소사실의 요지 피고인은 정보통신망을 통하여 음란한 부호ㆍ문언ㆍ음향ㆍ화상 또는 영상을 배포ㆍ판매ㆍ임대하거나 공공연하게 전시하여서는 아니 됨에도, 2012. 9. 일자불상경 서울 영등포구 C빌라 가동 201호에 있는 피고인의 주거지에서, 인터넷 파일공유 사이트인 파일조(www.filejo.com)에 'D'라는 아이디로 접속한 후, '{신작}통학버스 기획물 흔하지 않다 추천!!'이라는 제목으로 남녀의 성기 부분, 남녀가 성관계하는 장면 등 일반인의 정상적인 성적 수치심과 선량한 성적 도의관념에 반하는 음란한 영상을 성인게시판(게시물번호 : E)에 업로드 하는 방법으로 공공연하게 전시하였다.
