피고인은 2013. 7. 14. 09:30경 서울 양천구 B에 있는 C식당 앞 도로에서 위 음식점 안에서 피해자 D(24세)이 자신을 쳐다보며 기분 나쁘게 아는 척을 한다는 이유로 '뭘 쳐다봐 개 씨발놈아'라고 욕을 하였고, 이를 목격한 D의 일행인 피해자 E(24세)로부터 사과하라는 요구를 받자 화가 나 주먹과 발로 피해자들의 얼굴을 수회 때려 피해자 E에게는 약 2주간의 치료가 필요한 안구타박상 등을, 피해자 D에게는 치료 일수를 알 수 없는 윗입술이 찢어지고 송곳니 일부와 앞니 2개가 흔들리는 상해를 가하였다.
