1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. Gyeonggi-do 10,215 square meters of B forest land in Kimpo-si was owned by C. On October 15, 1984, ownership was transferred to D, E, F, G, H, I, I, and J on October 15, 1984, and on December 10, 1985, 832 square meters of land was divided into K forest and field, and registration was converted into 822 square meters of L road (hereinafter “land before division”).
B. Around 1986, the Plaintiff (the title at that time was Kimpo-gun) purchased each of the above lands from D, E, G, and F by fixing KRW 894,640 for each of the lands of P, Q, B, and R as compensation in order to construct a road from Kimpo-si to NO located in Kimpo-si to approximately KRW 7.5 km (hereinafter “instant construction”).
For the instant construction project, there is an indication that the Plaintiff paid the amount of compensation on March 12, 1986 as KRW 374,400 with respect to B forest land 832 square meters (owner D et al. and six others) in the road site acquisition register prepared by the Plaintiff at the time.
C. On November 26, 191, the registration of ownership transfer was completed on several occasions, including the completion of the registration of ownership transfer to non-S and non-five persons on the land before the instant partition. Ultimately, the registration of ownership transfer was completed on June 25, 2013 due to the sale on June 21, 2003. The Defendant purchased T forest land 5,623 square meters from S, etc. on June 21, 2003.
On July 26, 2005, U.S. 166§³, V. 190 square meters, and W. 107 square meters (hereinafter “instant two land”) are divided into the land before the instant partition. The said land became the same as L road 359 square meters (hereinafter “instant one land”).
E. On December 11, 2003, the general steel structure factory building was newly constructed on the land above the land, and the registration of ownership preservation was completed in X name of the corporation.
F. Meanwhile, on October 11, 2005, the Plaintiff acquired U land and V land from the Defendant on December 19 of the same year for the extension of the AA road between Zri from Yri to Zri, and completed the registration of ownership transfer on the 27th of the same month.
