A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On March 23, 2019, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from D Driving) driving three lanes in front of Seoul Special Metropolitan City Nowon-gu at a 0.116% alcohol level while under the influence of alcohol level 0.16% in front of Nowon-gu in Seoul Special Metropolitan City, and made a turn to the left at an insular speed depending on the d turn from the face of the tin railroad basin.

At the same time, there was a crosswalk in which signal lights were installed, and there was a person waiting in the signal waiting in order to build a road, so in such a case, there was a duty of care to prevent accidents in advance by reducing speed and properly operating the brakes and steering gear in accordance with the new code while living well on the right and the right of the driver of the motor vehicle.

Nevertheless, the Defendant neglected to do so and neglected to observe the signal while neglecting the influence of alcohol, thereby violating the signal and not properly operating the brakes and steering gear, and received the left-hand part of the victim E (the age of 35) who was waiting for signal at the sidewalk due to occupational negligence.

Ultimately, the Defendant driven the said car in a state where it is difficult to drive the car normally due to influence of drinking, resulting in the Defendant’s injury, such as the cutting of a frithr, which requires treatment for about six weeks.

2. On March 23, 2019, the Defendant was driving a vehicle with Cromatic alcohol level of 0.116% in the section of about 18 km from the front day of the Gangnam-gu Seoul F building and the restaurant in the first floor to the place indicated in the preceding port at around 07:25 on the same day.
