A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person engaging in driving motor vehicles B;

On June 18, 2019, at around 21:30, the Defendant driven the said car with a blood alcohol concentration of 0.150%, and led to the second line road in front of Incheon Seo-gu, Incheon to drive the said car in the direction of Kimpo, from the direction of the inspection team D.

At that time, since the passage of a vehicle is frequent, there was a duty of care for those engaged in driving duties to see the front door and to prevent accidents by operating the brake system in a timely manner.

Nevertheless, under the influence of alcohol, the Defendant, while negligent in driving the FM5 vehicle in the front of the Defendant’s vehicle traffic signals, took the back part of the FM5 vehicle driven by the victim E (the age of 35) who was in the front of the Defendant’s vehicle and became the front part of the Defendant’s vehicle, and due to the shock of SM5 vehicle, the victim G (the age of 65) who was in the front of the signal, was driving by the victim G(the age of 65) who was in the front of the instant signal, was able to receive the back part of the HM5 vehicle.

Ultimately, the Defendant, as seen above, driven the said car in a state where normal driving is difficult due to influence of drinking, and suffered injury to the victim E, such as salt, tension, etc., of the trend that requires a two-day medical treatment, and the victim G, with approximately two weeks’ treatment.

2. The Defendant violated the Road Traffic Act (driving) in a section of about 5 km from the date and time border specified in paragraph (1) of this Article, from the road near the king-dong, Seo-gu, Incheon to the front road of the same Gu, and driving a B-hand car with the blood alcohol concentration of 0.150% under the influence of alcohol.
