1. Claim for the destruction of a computer file in which technical and business information as shown in attached Form 2 is entered among the instant lawsuit, and attached Form 3.

1. The following facts may be found either in dispute between the parties or in combination with the whole purport of pleadings as set forth in Gap evidence Nos. 1 through 4, 9, 12, 13, 15, 17 through 26, 28 through 30, 32 through 44, 46 through 79, 81 through 83, 86, 87, 90 through 92, and Gap evidence No. 8 through 10, 1, 2, and 3.

1) The Plaintiff was established on December 28, 200 ( around January 1, 1992) as the Plaintiff’s personal business, the representative director of the Plaintiff, and was converted into a corporation on January 1, 2001.

(2) Defendant B (a) worked as the vice president of the Plaintiff from May 23, 2005 to January 31, 2010; (b) entered Defendant H Co., Ltd. (hereinafter “Defendant Company”) on February 4, 2010, and entered the PU (PU (hereinafter “Defendant Co., Ltd.”) in the PU business division: A company working in the PU business division, which is a device to injecte two or more materials into gold-types with high voltages and to inject them into gold-types. (c) Defendant B has been in charge of any foreign business related to mixed-types, while working in the PU (hereinafter “Defendant Co., Ltd.”).

3) From February 25, 1999 to January 22, 2010, Defendant C served as a production director or factory manager who exercises overall control over the Plaintiff’s product production, technical design, and domestic business affairs. On February 1, 2010, Defendant C joined the Defendant Company and served as the head of the technology development division in charge of the Plaintiff’s design and key parts purchase business, while working in the PU business division. 4) Defendant D was discharged from office as the Plaintiff’s employee from August 1996 to February 2004.

On February 1, 2010, the defendant company entered the PU business department and worked in the PU business department, and was in charge of the production of the singing and mixing hedging drawings.
