A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
1. Obstruction of business and damage to property;
A. From around 23:50 on July 25, 2013 to 0:30 on July 26, 2013, the Defendant brought a notice of the council of occupants’ representatives posted on the apartment bulletin board at Pyeongtaek-si apartment management office, and brought a complaint against the victim D, who is an employee, and raised a large amount of damage. The Defendant interfered with the victim’s management work by force, such as “the victim, who is a staff member, was fluorcing flus. Masing flus. Mas that the president of the occupants’ representative meeting is the first day. Mas that the flus are being flusing. Mas, the Defendant interfered with the victim’s apartment management work by force.”
B. On August 14, 2013, at around 02:36, the Defendant: (a) opened an automatic door from the underground 106-dong apartment building to the hack pipe; (b) opened trees to prevent the automatic door from being closed; and (c) destroyed and damaged the 20,000 won market price, which is the joint ownership of the owner of the apartment.
C. At around 20:00 on September 12, 2013, the Defendant, at the rebuilding association office located in the above C Apartment 2, had been holding a meeting in the presence of the representative of the Dong and the head of the management office, etc., the victim E, who is the chairperson of the council of occupants’ representatives, without permission, entered the large interest, and thereby interfered with the victim’s meeting’s progress by force for approximately 30 minutes, by failing to comply with the request of the victim to go.
On September 14, 2013, at around 10:00, the Defendant interfered with the management of the victim F apartment by cutting off the name of the council of occupants' representatives on a standard guidance banner for food waste and the name-saving personnel banner, each of which was set up on the after door of the above apartment, and at the same time damaged the property equivalent to KRW 60,00 won at the market price owned by the council of occupants' representatives.
E. The Defendant is an apartment complex from around 10:00 to 19:00 on September 20, 2013.
