Basic Facts
Since the Defendant promoted the academic development in the field of applied microorganisms and industrial microbiology in 1973, and the universities, research institutes, and experts in related industries were established for the active human and material communication based on academic productive foundation, the Defendant is an academic organization that carries out the business, such as the publication of the English academic journal “C” (hereinafter “instant academic journal”), with the aim of promoting the academic development in the field of D engineering.
On September 16, 2013, upon the Plaintiff’s application for publication, the Defendant published the thesis of “I” (hereinafter “the thesis of this case”) in which the Plaintiff, H, F, and G were jointly authors.
The parts related to this case among the rules on the implementation of the Defendant's Research Ethics Deliberation (hereinafter referred to as the "Rules on Implementation") are as follows:
Article 1(Purpose)The implementation Rule aims to present basic principles and procedures with respect to the deliberation of research ethics necessary to prevent improper research activities and to ensure research ethics at the publishing and academic conference related to the defendant science.
Article 2 (Scope of Application) This Enforcement Rule covers theses published in the academic journal issued by the defendant and the contents of the compilation published for academic conferences.
Article 3 (Scope of Research Cheating) Research misconducts presented in these Guidelines (hereinafter referred to as "misappropriations") refer to forgery, alteration, plagiarism, and expression of author author's author's author's author's author's author's author's author's author's author's author's author'
(1) "Forgery" means any act of falsely creating data, research findings, etc. that do not exist.
(2) “Alteration” means an act of distorted the contents or results of research by artificially manipulating materials, equipment, processes, etc. of research, or by arbitrarily transforming or deleting data.
Article 4 (Subject Matter of Deliberation on Research Ethics) An Ethics Committee may commence an investigation to verify the authenticity of research and make judgment in any of the following cases:
