A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, on March 26, 2008, received a summary order of KRW 700,000 from the Cheongju District Court on March 26, 2008 to a fine of KRW 300,000 for a violation of road traffic laws (drinking), from the Cheongju District Court on October 30, 209 to a fine of KRW 2.5 million for the same crime, and from November 4, 2016 to a fine of KRW 5 million for the same crime, respectively.

On February 9, 2018, the Defendant, without a driver’s license, driven a DNA car at a section of about 1 km from the front of the Cheongju-si B “C” food with approximately 0.153% alcohol content while under the influence of alcohol during blood without a driver’s license, to the front of the road from the front of the Cheongju-si B “C” food in the same Gu to the front of the road.

Accordingly, the defendant, who violated the prohibition of drinking at least twice, was driving a motor vehicle without a driver's license under the influence of alcohol.

Around 12:47 March 6, 2018, the Defendant driven a DNA car, one of the Defendant’s possession, without obtaining a driver’s license, from the street of the Cheongju-gu Tax Office located in 151, Chungcheongnam-gu, Chungcheongnam-do to the front of the E apartment.
