Punishment of the crime

1. On August 16, 2012, the Defendant: (a) around 21:40 on August 16, 2012, the Defendant demanded F, an employee, to charge LPG gas to the Defendant’s G rocketing car at the charging station of the victim D’s D operation located in Busan Sho-gu.
The Defendant had no cash at all at that time, and two copies of credit cards in his possession were suspended from payment, and there was no intention or ability to pay the LPG gas from F even if he was charged with the LPG gas.
Nevertheless, the Defendant, by deceiving F as above, was charged with LPG gas equivalent to KRW 58,973 at the market price by deceiving F.
2. The Defendant violated the Punishment of Violence, etc. Act (a collective injury by deadly weapons, etc.) charged LPG gas to the above passenger car at the time and place specified in paragraph (1) and presented H credit card in the name of H that the Defendant embezzled to the victim F (the age of 43) but the card was suspended from payment as the result of confirmation that the card was suspended, the Defendant went to the above charging office with the victim by transferring the gas charge to account transfer.
In order to transfer gas charging charges in the above office, the Defendant sent a phone call to the Defendant’s front wife I, but did not have a telephone call, and confirmed that the Defendant’s resident registration number and telephone number were recorded in the phone page, and that the Defendant’s call was suspended but the call was made by the number indicated in the phone page.
In the meantime, when the victim got the credit card under the above H from D, the president of the charging station, to be a theft card, the Defendant again presented the credit card under the name of I, and the other employees J of the filling station tried to confirm whether it is possible to obtain approval with the credit card outside the office with the first credit card, and the Defendant also tried to go to the office, and the victim did not go to the office. However, the Defendant went to the office by spreading the arms of the victim.
