Defendant

A shall be punished by a fine of 2,00,000 won, Defendant B and C by a fine of 1,000,000 won.

The above fine is imposed against the Defendants.

Punishment of the crime

The project is an energy saving facility support project to reduce the management cost of farming and fishing households due to increase in the prices of national oil and farming materials and to promote energy use efficiency, and the subsidy related to the project was required to be paid on the condition that the target is paid 40 percent of the total project cost in the year 201 and 50 percent of the total project cost after the year 2012.

1. Defendant A

A. The Defendant: (a) was a person who sets a farmer’s house in the husband F in the name of the husband F in Gyeyang-gun, Namyang-gun E; (b) had the installation project completed the construction from the farmer to the farmer, and submitted evidentiary documents, such as the details of the project and the certificate of self-payment; and (c) had the construction cost paid only part of the construction cost, and had G, a contractor, do the construction work without paying the remainder, and had the Defendant perform the project by manipulating documents as if the Defendant paid the full amount of the self-payment, thereby receiving subsidies.

Accordingly, in collusion with H operating the above G, the Defendant prepared and submitted a request for subsidy payment stating that “The public official in charge of the energy use efficiency project in the name of the public official in charge of the energy use efficiency project in the 2013,846,000 won of the total project cost shall be the F and the said construction shall be completed with the actual cost of KRW 13,846,00,000 of the total project cost, and the Defendant received the advance payment of KRW 4,140,000 of the subsidy on April 9, 2012, which shall be paid the remainder of KRW 2,760,000 of the subsidy.”

However, facts are paid to H only an amount equivalent to 4,819,00 won out of 7,419,000 won.
