Defendant shall be punished by a fine of KRW 5,000,000.
If the defendant does not pay the above fine, 50,000 won shall be paid.
Reasons
Punishment of the crime
1. On April 27, 201, the Defendant prepared qualification-based private document in collusion with C, and around 27, 201, at the office of the Empic branch of the Empic branch located in Seocheon-si, the Defendants were not delegated by F, the representative director of the said company, with respect to the conclusion of the contract for the completion of the construction work, the Defendants stated “mutual name: E Co., Ltd., address: Gyeonggi-do, representative director F, and agent C” in the column of the “construction subcontract” by means of a computer, and stated “H: address: Suwon-si, Suwon-si, Suwon-do, the representative director: J., and affixed the corporate head of the said company on the name of the representative director F.
Accordingly, the Defendant, in collusion with C, prepared one copy of the subcontract agreement for construction work, which is a private document on rights and obligations, with the intent of exercising the authority as an agent of the said company without authority.
2. The Defendant, in collusion with C, exercised the construction work subcontracting contract in collusion with C, at the time and place set forth in Paragraph 1, and at the same time and place, delivered it to K as if it had been duly formed.
3. On April 5, 201, the Defendant: (a) in collusion with C, entered the receipt, daily payment: 0 million won; (b) the amount was fixed with L building equipment, windows, glass, and deposit money for miscellaneous construction; (c) April 5, 201; (d) the receipt: E Co., Ltd.; and (e) the representative: F; and (e) forged one receipt under the name of the above company, which is a private document concerning the certification of facts by sealing the corporate head of the above company on the name of the representative director F; (b) the receipt, which is a private document concerning the certification of facts, was affixed at the same time, place, by the same method; (c) the said amount was received on April 5, 201; (d) the amount was paid as deposit money for tin construction of the above L building; and (d) the representative director of E Co., Ltd.; and (e) the name of the F Co., Ltd.; and (e) the name of the above company.
