The punishment of the accused shall be determined by eight months of imprisonment.

Punishment of the crime

On February 20, 2013, the Defendant was sentenced to one year to imprisonment for a violation of the Act on Special Cases concerning the Settlement of Traffic Accidents in the Southern Branch of Gwangju District Court on February 20, 2013 and completed the execution of the sentence in the Southern Prison on February 21, 2014.

1. On September 2, 2014, the Defendant, around 13:26, 2014, committed as if he would normally pay a taxi fee in the vicinity of the bus terminal located in Yaeong-gu, Yaeong-gun, Yaeong-gun, the Defendant: (a) boarded in C taxi in the victim B (age 66); and (b) had the victim drive the said taxi to the Mon-si post office located in the Mon-gun, Jajin-gun.

However, the defendant was not in possession of cash, etc. at the time, and there was no intention or ability to pay taxi charges due to no special property.

The Defendant, by deceiving the victim as above, had the victim operate the said taxi to the said Mambling post office, but did not pay 40,600 won to the said Mambling post office, thereby acquiring property benefits equivalent to the same amount.

2. On November 18, 2014, the Defendant, around 14:13, 2014, committed as if he would normally pay the taxi fee in the vicinity of the port of return in Seopo-si, Seopo-si, and was aboard a victim D (year 56) E-si, and had the victim drive the said taxi at the Sungsan port in Sungpo-si, Seopo-si, Seopo-si, Seopo-si.

However, the defendant did not have the cash, credit card, etc. to pay taxi charges, so there was no intention or ability to pay the taxi charges to the victim.

As above, the Defendant, by deceiving the victim as above, had the victim operate the taxi above to the above Sungsan Port, and did not pay 36,300 won to the victim, thereby acquiring property benefits equivalent to the same amount.
