Reasons
Punishment of the crime
The defendant is a person who lacks the ability to discern things or make decisions due to mental disorders, such as a part of a baby, etc., due to mental disorders.
1. On June 14, 2020, the Defendant: (a) around 13:50 on June 14, 2020, 2020, the Defendant boarded the cab that was operated by the victim B in the vicinity of the New Station by the Eunpyeong-gu Seoul Metropolitan Government, and had the victim operate the said taxi to the vicinity of the Defendant’s house located in Eunpyeong-gu Seoul Metropolitan Government.
However, the defendant did not have any intention or ability to pay taxi expenses because he did not have any money in possession.
Ultimately, the Defendant, by deceiving the victim as above, had the victim operate a taxi and did not pay KRW 7,800 to the victim, thereby acquiring property benefits equivalent to the same amount.
2. On June 16, 2020, the Defendant, around 22:55 on June 16, 2020, boarded a F taxi operated by the victim E in the vicinity of the 306 mountain basin, Eunpyeong-gu Seoul, Eunpyeong-gu, Seoul, as if he would pay the taxi fee, and had the victim move to the network-dong, and again had the victim drive the said taxi up to 2 out of the entrance near the mountain basin.
However, the defendant did not have any intention or ability to pay taxi expenses because he did not have any money in possession.
Ultimately, the Defendant, by deceiving the victim as above, had the victim operate a taxi and did not pay 18,100 won of the taxi fee, thereby acquiring property benefits equivalent to the same amount.
3. On August 7, 2020, the Defendant: (a) around 22:52, around August 7, 2020, 2020, took a train near H middle schools located in Eunpyeong-gu Seoul Metropolitan Government, to the J-si operated by the victim I; and (b) caused the victim to operate the said taxi to the front edge of the Eunpyeong-gu Seoul Metropolitan Government K.
However, the defendant did not have any intention or ability to pay taxi expenses because he did not have any money in possession.
Ultimately, the defendant deceivings the victim as above and belongs to it.
