A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 18, 2015, at around 00:41, the Defendant sought to return home from the victim E (the aged 35) who is the police officer of the Pyeongtaek Police Station D Zone D Zone called up after receiving a report from 112 that the Defendant was used on the floor under the influence of alcohol, and tried to take aboard the patrol vehicle.

이에 피해자가 순찰차에 승차하려는 피고인을 제지하자, 피고인은 피해자에게 “야! 개새끼야, 경찰차에 타면 왜 안 되냐 왜 경찰새끼가 말을 거냐. 씨발! 양아치 새끼야. 야! 좆빨아 공무원 주제에 씨발!”이라고 소리치며 손으로 피해자의 오른팔을 잡아당기고, 계속해서 피해자로부터 인적사항을 알려줄 것을 요구받자 피해자에게 “지랄! 네가 한번 알아봐 봐라! 씹할 새끼야! 말 똑바로 해! 니 맘대로 해봐, 새끼야! 네 이름은 뭐냐 한 번 보자!”라고 소리치며 왼손으로 피해자가 입고 있던 경찰제복 조끼 오른쪽 부분을 잡아당기고, 발로 피해자의 다리를 걷어차고 손으로 피해자의 팔을 비틀어 피해자에게 약 10일간의 치료가 필요한 경추의 염좌 및 긴장 등의 상해를 가하였다.

Accordingly, the defendant interfered with the legitimate performance of duties by police officers on the prevention, suppression and investigation of crimes, and at the same time injured the victim.
