피고인들은 위 공모에 따라, 피고인 B은 2013. 7. 중순경 대구 이하 불상지에서 불법 게임기 유통업자인 일명 E(이명 F)으로부터 등급분류 받은 내용과 달리 특정 구간에서 자동으로 아이템카드가 배출되고 게임기 이용자의 조작과 무관하게 자동누름장치(일명 똑딱이 또는 딱따구리) 만으로도 아이템카드가 배출되며, 특정 캐릭터 문양의 카드가 연속 배출되고, 등급분류 받은 내용의 프로그램과 불법으로 개변조된 프로그램(속칭 영업버전)이 모두 작동되도록 개변조된 ‘레전드 오브 히어로 3’ 게임기 40대를 1,800만 원에 구입하여 제공하고, 피고인 A은 광주 북구 G, 2층을 임차하여 ‘H’ 상호로 게임장을 마련한 다음 B이 제공한 게임기를 게임장 내에 설치하여 손님들에게 제공하고, 피고인 C은 2013. 8. 2. 자신 명의로 게임장 등록을 마친 후 2013. 8. 5.경 위 게임장이 단속되자 실제 업주 행세를 하며 진술서를 작성하여 단속경찰관에게 제출하였다.
