Reasons
1. Determination as to the cause of claim
A. Facts of recognition 1) Plaintiff A died on October 9, 201 from the deceased I (OO).
hereinafter referred to as “the deceased”
Plaintiff B and C are the deceased’s spouse. On the other hand, Defendant D is the deceased’s spouse, and Defendant E, F, G, and H are their children. The J died on March 12, 2012 (hereinafter “instant apartment”) was the deceased’s possession of real estate listed in paragraph 1 of the attached Table (hereinafter “instant apartment”). According to the title trust agreement with K where the deceased was the wife, the registration of ownership transfer was completed on December 10, 1983.
(Seoul Western District Court Decision No. 10631, Feb. 12, 1983). On the other hand, the Plaintiff (title truster) entered into an agreement on title trust with K (title trustee) around February 198, and provided K with expenses, such as the purchase-price. Accordingly, on February 3, 1988, K did not know of the fact and the land specified in attached Table No. 2 (hereinafter “the forest of this case”).
(4) On June 4, 2015, K entered into a sales contract for the apartment of this case and completed the registration of ownership transfer (Seoul District Court Jindo District Court, Jindo District Court, 1104. d. 4) and died on June 4, 2015. ① As to the shares of 11/22 shares in the apartment of this case, as to the shares of 3/22 shares in Defendant D, Defendant E, F, G, and H, respectively, on June 4, 2015, the registration of ownership transfer was completed on June 4, 2015 for respective shares of 2/22 shares in the apartment of this case.

In addition, according to the above death, with respect to the shares of 11/22 in the forest of this case among the forest of this case, the ownership transfer registration for each of 2/22 shares in the defendant D's 3/22 shares in the forest of this case was made on June 4, 2015 for each of 2/22 shares in the defendant E, F, G, and H respectively.
