A defendant shall be punished by imprisonment for three years.

Punishment of the crime

On February 2010, the Defendant, “2018 Godan856,” obtained access from a beauty room where the victim B was employed as a guest, and became a school member on the premise of marriage with the victim, and was committed as if the victim was the cause of suspension from office of the construction company affiliated with C Group.

1. Around July 29, 2010, the Defendant stated that “A credit card payment is overdue” to the victim at the beauty shop “E Il-do” which was the victim in Jeju-si, the Defendant would receive monthly pay from the following month if he/she lends money to the victim.”

However, in fact, the Defendant had already been a legal spouse and children, and had no intention to marry with the victim while living together with other women at the time, and was not an employee of the Construction Company C of the Group, and did not have any particular income or assets, and did not have any intent or ability to repay the said money even if the Defendant borrowed the said money from the victim.

Accordingly, the Defendant, by deceiving the victim as above, received 2.6 million won from the victim to the company bank account in the name of the Defendant on the same day as the loan money, and received 93,890,000 won in total over 30 times from around that time to September 1, 2012, as shown in the attached crime list (1).

2. On August 30, 2010, the Defendant made a false statement that “If a credit card is lent to purchase nanotechnology and digital camera, the payment will be made later on the credit card settlement date.”

However, the defendant did not have any intention or ability to pay the credit card price normally even if he borrowed the credit card from the victim due to the absence of particular income or assets as above.

Accordingly, the defendant deceivings the victim and receives Samsung Card in the name of the victim on the same day from the victim, and Nowon-do, which is equivalent to KRW 1,570,00.
