A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
A. On November 201, 2010, the Defendant: (a) issued a new bank’s certificate at C office located in Seocho-dong Seoul, Seocho-gu, Seoul; (b) printed out the “D” letter using the computer network; (c) prepared a confirmation certificate on the contents of the transfer to E in addition to the D letters; and (d) stored it by printing it. At that time, the Defendant sent the modified certificate to F of the public official working in the Seocho-gu Job Economic Department, Seocho-gu, Seoul, and then sent it by e-mail as if it was duly formed.
Accordingly, for the purpose of uttering, the defendant altered a certificate of confirmation in the name of a new bank, which is a private document related to a certificate of fact, and sent it by e-mail to the employee in charge of Seocho-gu Office.
From that point to December 201, 201, the Defendant altered each confirmation document over a total of 20 times as shown in the annexed Table 1, and exercised each time each time.
B. On November 201, 2010, the Defendant violated the Subsidy Management Act prepared a false attendance record at C office with the absence of working for at least 30 days for at least 30 days, and submitted it to the relevant Gu office, received the subsidy, and then remitted the remittance certificate that transferred the subsidy to the worker D account under the name of E as stated in paragraph (1), and submitted it to the Seocho-gu Job Economy and the public official in charge, and used the subsidy received for the company expenses, not for the relevant worker’s personnel expenses.
The Defendant received a subsidy of KRW 83,211,200 from the above method to the beginning of January 2012 by falsely applying for a total of KRW 94 times as shown in the attached Table 2, and received a subsidy of KRW 83,211,200 as the expenses of the company.
