A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
1. Around October 2009, the Defendant: (a) around October 2009, the Defendant: (b) at the construction business office “Y”; (c) at the construction business office, the Defendant, in which the Defendant located in the Suwon-si X, made an investment in the Z to purchase the Yongsan-si Water Zone AA and to carry out the housing site development business; (d) the Defendant purchased this land and converted it into the housing site; and (e) had the victim AB, AC, AD, and AE recommend investment.
However, even if the defendant received money from the victims for the investment funds for housing site development projects, he did not have any intention or ability to purchase land and promote housing site development projects.
On October 15, 2009, on October 21, 2009, the Defendant deceptioned victims through Z and acquired KRW 100 million from AB of the victim, KRW 50 million from AB of the victim on October 29, 2009, KRW 50 million from AC of the victim on October 29, 2009, KRW 10 million from AD of the victim on November 5, 2009, and KRW 300 million from AE of the victim on November 13, 209.
2. Forgery of private documents or the display of falsified private documents;
A. “AA Civil Works and Electric Source Housing Development Plan” in the name of C, and the Defendant at around October 2009, in the office of “Y” around the same day, the Defendant divided the AA land into 12 lots under the “A Civil Works Corporation and Electric Source Housing Development Plan” by means of a computer, and prepares a map indicating the specific size, road area, and building area of each land to be sold, and then trade the said land under the following conditions:
1. Four months after the commencement of construction period;
2. The height of the retaining wall is less than two meters, and
3.The width of a road shall be 8m-6m or m-6m or more;
4. The gradient of a road is less than 25%;
5. A septic tank shall be combined by parcel;
6. In cases of water supply, groundwater development;

9. It shall be completed to cover up to 17 per cent of the land-use area as a unit assembly house for completion.
