피고인은 2013. 2. 12. 23:50경 서울 은평구 B에 있는 서울은평경찰서 C파출소 앞길에서 여러 명의 행인들이 듣고 있는 가운데 위 C파출소 소속 경찰관인 피해자 D에게 “이 쓰레기 같은 새끼야, 모가지를 따버린다, 너는 언젠가 죽여 버린다, 짭새 같은 새끼야!”라고 소리쳐 공연히 피해자를 모욕하였다.
