A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
around March 17, 2016, the Defendant posted a letter stating that “the 216th page of the world of Niberaland,” which is an Internet Nene, is selling “the 216th page of the construction site,” which is a medium-sized young child’s book, to the victim C(38 years of age) who reported and contacted, would sell KRW 465,00 to the 38 years of age of deposit account account book.
However, the defendant did not have the above old children's book, and even if he received the money from the victim, he thought that he will use it for living expenses, etc., and he did not have the intention or ability to sell the above book to the victim.
Nevertheless, the Defendant, by deceiving the victim as above, received 465,000 won from the victim to the Agricultural Cooperative Account (Account Number: D) in the name of the Defendant, and acquired it by remittance from the victim as the sales proceeds of the middle and middle infant books.
In addition, from that time to May 3, 2016, the Defendant received total of KRW 10,574,000 from 28 victims in the same way through the same method, such as the list of crimes in attached Form 28.

1. On May 3, 2016, the Defendant posted a false statement on the Defendant’s house located in the Dong-gu E apartment 105 402 dong-gu, Chungcheongnam-gu, Chungcheongnam-gu, and on the Internet “F” website, in the absence of a golf loan set, to sell golf loans, without which the Defendant received KRW 700,000 from the victim G to the Plaintiff’s single bank account (I) in the name of H in the name of the Defendant’s mother as the purchase price for golf loans.
2. The Defendant posted a false statement on the date, time, place, and fact in Paragraph 1, and on the Internet “F” website in which no golf bond set is sold, and the Defendant received 480,000 won from the victim J to the said account in the name of the purchase price for golf bond.
3. The Defendant is at the place specified in paragraph (1) around May 4, 2016.
