A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On April 28, 2016, the Defendant posted a notice on April 28, 2016, stating that he/she sold her panty panty sets on the bulletin board of the NAV Kab Kab, a place where the Defendant reported and contacted the above writing, and then false statement was made to the victim D as if he/she sold the said her panty sets.
However, the defendant did not have the above panty ties, so even if he received money from the injured party, he did not have the intention or ability to sell it.
The defendant deceivings the victim as above and transferred 60,000 won to the national bank account (E) in the name of the defendant's name as sales proceeds from the same day from the victim.
In addition, from around that time to July 7, 2016, the Defendant deceiving 45 victims, such as the victim D, on a total of 45 occasions as shown in the attached list of crimes (1) by the same method, and received a total of 3,61,000 won from the victims.
2. On June 19, 2016, the Defendant posted a letter stating that he/she sold the above automatic content at a non-permanent place, on the bulletin board of the NAVER C, a medium country, and false statement was made to the victim F, who reported and contacted the above letter, as if he/she sold the above automatic content.
However, the defendant did not have the above automatic contents, so even if he received money from the injured party, he did not have the intention or ability to sell it.
The defendant deceivings the victim as above and was transferred 80,000 won as sales proceeds from around 23:08 on the same day to the new bank account (G) in the name of the defendant.
3. On July 1, 2016, the Defendant, at the Defendant’s home located in the Seoul Special Metropolitan City Gwangjin-gu H 102, posted a notice on the Defendant’s bulletin board the NAV 102 “China” bulletin, stating that Ma will sell Y lX300T, and then false statement was made to the victim I who reported and contacted the above writing.
However, the defendant does not have this end.
