A defendant shall be punished by imprisonment with prison labor for not more than ten months.

Punishment of the crime

1. No person shall engage in the business of converting tangible and intangible results acquired by using game water into a business;

On February 2, 2015, the Defendant: (a) followed by D the game forum of “C Gameland” located on the Southern-gu Seoul and the second floor of the building, and had been thought to be operated by himself.

E subleases the defendant with the "C Gameland" game for one's own facilities, etc., and D lends all of the game machine installed in the above game room to the defendant by purchasing it by him and lending it to E and D, and the defendant actually operates the game room and was engaged in money exchange business in the game room.

Defendant, E, D, and F, according to the aforementioned role sharing, from February 7, 2015 to February 17 of the same month (F from February 9, 2015 to February 13, 2015), installed 45 games in the C Gameland to provide customers with 10% of the card obtained through the use of the game machine, and provided customers with automatic playing devices (hereinafter referred to as “one-way playing”) for use. The Defendant and E, D, and F set the class card for each rank and paid in cash the remainder after deducting 10% of the card from the fee.

Accordingly, the defendant, in collusion with E, D, and F, engaged in the business of returning tangible and intangible results obtained using game water.

2. No one shall distribute, exhibit, or store game products, the contents of which are different from the rating classified by the Game Water Management Committee, or provide such for the use thereof, and shall engage in business of converting the results of intangible results acquired by using game products into a business.

From April 18, 2015 to April 24, 2015, the Defendant installed 40 game machine of “pool-do” game in the “H Gameland” operated by the Defendant in Gwangju North-gu, Gwangju-gu. Unlike the contents classified by the Game Water Rating Board, there exists a smoke function different from the contents classified by the Game Water Rating Board, and the image shown on the screen.
