Reasons
Punishment of the crime
1. No one shall provide game water not classified by the Game Water Management Committee for distribution or use, or engage in business of converting the results of tangible or intangible outcomes acquired through the use of game water;
Nevertheless, Defendant A, while operating a game room on the third floor of the Dong-gu Incheon Metropolitan City L Building without trade name, set up 40 game machine in the sea open game which was not rated by the Committee on Water Management, and takes charge of the management of business affairs and revenue for exchanging the result of the game. Defendant B, upon receiving a request from Defendant A while working as an employee of the above game site, purchased the game machine at the above sea open game site from F, and set up the game room in the above game site, and recruited customers visiting the game site to take charge of exchanging cash, which is the result of the game.
The Defendants offered as above, from July 2, 2015 to July 29, 2015, set up 40 game machine 10 won per cash of 100 won for the game money acquired by customers by the game water management committee on the third floor of the Dong-gu Incheon Metropolitan City from July 2, 2015 to July 29, 2015.
As a result, the Defendants conspired to provide game water that was not rated by the Game Water Management Committee, and carried on the exchange business of tangible and intangible results obtained through the use of game water.
2. No one shall distribute or use game water which was not rated by the Game Water Management Committee for public offering by Defendant G or Defendant F.
Nevertheless, around June 2015, Defendant G requested that the Committee on the Management of Game Water supply 40 of the sea which was not rated by the Committee for the Management of Game Water, Defendant G contact Defendant F with Defendant F to purchase and install 40 of the sea-going game machine, and Defendant F.
