Reasons
Punishment of the crime
Defendant A is a person engaged in fisheries as the captain of the fishing vessel E (9.7 metric tons, mother vessel) permitted to operate a coastal vessel at the port of Seocheon-gun. Defendant B is a person engaged in fisheries as the captain of the fishing vessel F (7.93 tons, subsidiary vessel) permitted to operate a coastal vessel at the port of Seocheon-gun. Defendant C is a two vessel owner of the above fishing vessel.
1. A person who intends to run a fishery business falling under coastal fishery, among those using a powered fishing vessel, the gross tonnage of which is less than 10 tons as a joint crime committed by Defendant A and Defendant B, shall obtain permission for each fishing vessel or fishing gear from the Mayor/Do Governor;
Nevertheless, from around 09:20 on September 3, 2017 to around 09:50, the Defendants captured approximately 8 km worth 60,000 won at the market price using the coastal network fishing gear of the E (9.7 tons) and its affiliated FIx 35-54.30 N 126-14.30E) at the 4.6 Eth (FIx 35-54.30N 126-14.30E) from the end of the Gun-si, Gun-si, Do-si, Jeollabuk-do, Jeollabuk-do, without obtaining permission for the coastal network fishing gear of the Gun mountain market, and captured approximately 28 km from around that time to October 29, 2017 as described in the daily list of crimes in attached Table 1.
2. The captain of a ship that intends to enter the water zone, etc. of a defendant A trade port shall not report or report by fraud or other improper means;
Nevertheless, the Defendant, at around 16:45 on September 12, 2017, failed to report the entry and departure port at least eight times in total from around the time to October 30, 2017, from the port of port of port E (9.7 tons), a trade port located in 750-2, Seocheon-gu, Chungcheongnam-gu, Seocheon-gu, Seocheon-gu, Seoul-do, to the captain on board the port of port E (9.7 tons).
