Punishment of the crime

【Defendant A was sentenced to one year and six months of imprisonment for fraud, etc. at the Seoul Southern District Court on July 5, 2007, and the execution of the sentence was terminated at the Yeongdeungpo-gu District Court on August 8, 2008. On November 29, 2011, Seoul Southern District Court sentenced seven months of imprisonment for fraud, etc., and the judgment was finalized on December 7, 201. Defendant B was sentenced to one year of imprisonment for fraud, etc. on May 9, 2007 at the Seoul Southern District Court on May 28, 2008 and was released on May 7, 2008, and was sentenced to five years of imprisonment for fraud, etc. at the Seoul Western District Court on September 25, 2012, which became final and conclusive on November 21, 2012 by Seoul Western District Court on December 13, 2013.

【Criminal Facts】 The Defendants conspired to forge a real estate lease contract with respect to G apartment 4, 403, Songpa-gu Seoul Metropolitan Government G apartment owned by F, and then to present it as security to the borrower and to acquire the borrowed money.

1. The Defendants forged private document at a place where it is impossible to identify the location around October 2010, indicated that “Seoul Songpa-gu G Apartment 4, 403,” “180,000,000 won in the deposit column,” “Seoul Gangnam-gu HA” in the lessee column and “Seoul Gangseo-gu I apartment 809, 706, and F” in the lessor column and affixed F’s seal on the next page.

As a result, the Defendants forged one copy of the real estate lease agreement (5943 on the fixed date) in the name of F, a private document on rights and obligations, for the purpose of uttering in collusion.

2. On November 8, 2010, the Defendants were forged as described in paragraph (1) by borrowing KRW 90 million from the borrower M via the said K president L at the K office of Gangnam-gu Seoul Metropolitan Government Jtel 1608.
