1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The period during which Gap (Minister of Justice) entrusts Eul (Plaintiff) with the correction work, such as the establishment and operation of a private prison, etc., under Article 8 (Period of Contract) (1) of the Decree shall be 12 years from the date on which an entrustment contract under Article 4 (1) of the Decree is established;
(2) A shall permit B to renew the contract period, and the renewed contract period shall be 20 years from the day following the expiration date of the contract period referred to in paragraph (1).
December 11, 2014 (Expenses for Facilities Construction, etc.). Article 34 (Expenses for Facilities Construction, etc.) (1) The expenses, etc. incurred for the following facilities construction shall be borne by B:
1. Purchase of facilities and land necessary for the operation of a private prison, including a prison, an employee lodging house, an access road, and the site thereof, or measures necessary for the use thereof;
2. Civil engineering and landscape architecture works;
3. Installation of incidental facilities, such as machinery, telecommunications, sewage and wastewater treatment facilities.
4. Other persons subject to confinement in a private prison shall be male convicted prisoners who meet all of the following requirements, in installation of facilities and equipment necessary for the operation of the private prison:
1. Not more than two criminal offenders;
2. A convicted prisoner who has served not more than seven years in prison and has served a remaining term of not less than one year;
3. The maximum accommodation number of private prisons between the ages of 20 and under the age of 60 shall be 400;
Article 64 (Expenses for Operation of Private Correctional Institutions amended on January 16, 2017) (1) A shall pay to B the prescribed expenses for the operation of private correctional institutions each year, and these expenses shall be paid from the school administrative budget of the general accounts under the National Finance Act.
Article 66 (Payment of Operating Expenses) (1) A may be paid to B by up to 90% of the budget finalized by the provisions of Article 65, etc.

A. The plaintiff is a non-profit public-service corporation established on August 7, 2001 with a view to establishing and operating a correctional institution based on the happiness of the press, and on February 4, 2003, the plaintiff is not more than an entrustment contract with the Minister of Justice for correctional affairs in accordance with Articles 3 through 5 of the Act on the Establishment and Operation of Private Correctional Institutions, Etc. (hereinafter "Private Correctional Institutions Act").
