1. The Defendants, each of the Plaintiff, indicated in the attached Form No. 1, 2, 3, and 4, within the scope of the D Station located in Bupyeong-si, Seocheon-gu, Seoul.
Reasons
1. Basic facts
A. On January 12, 2015, Defendant A entered into a contract for the operation of a specialized store (hereinafter “instant operating contract”) with respect to the size of 37.90 square meters in the part of the shop (Ga) connected in order of each of the items in the attached drawings (i), (ii), (iii), (iv), and (i) the part of the shop (Ga), which was connected in the order of each of the above items, in order, between the Plaintiff and the Plaintiff, with the amount of KRW 20 million for performance security and thereafter, began to operate the instant store with the trade name “E” in accordance with the instant operating contract.
Section 1 (Purpose) The purpose of this Agreement is to promote increase in profit-making and to clarify the relationship between Cow Day Distribution and Partnership Contract in the operation of stores providing convenience and high-quality services to the customers using railroads in compliance with the operating system of Cow Day Distribution and all business regulations and this Agreement by a partner (the meaning of the Plaintiff; hereinafter the same shall apply) who operates a business in a railroad station managed by Cow Day Distribution (the meaning of the Plaintiff).
Article 3 (Definition of Terms) The definitions of terms used in this Agreement shall be as follows:
(1) Burial: A place in which a partner is selected as a commercial facility partnership in the distribution of Kowday among the commercial facilities in a railroad station and is able to sell goods and provide other services.
(2) The term "daily sales" means the total amount of cash sales, credit settlement sales (credit card, physical card), and non-cash sales (all the amount of discount of temporary leave of absence, accumulation of card, discount of card, etc.) with the total amount of sales generated during one business day at a store.
(4) Types of business: Services that a partner can operate in a store, and the types of business in a store shall be determined in advance by distribution in the store.
(5) General costs: Cost of goods, personnel expenses, direct expenses, electricity, water supply and sewerage, air-conditioning and heating, gas, and communications expenses, which are necessary for a partner to operate shops;
