1. Basic facts

A. The Plaintiff, in the former Northern-gun B, supplied electricity from the Defendant by concluding a power supply contract with the Defendant and operated low-ion warehouse facilities. The main parts of the terms and conditions of the Defendant’s power supply contract are as follows.

Article 39 (Facilities, such as Protective Devices, etc. Following Use of Electricity) (1) In cases where a customer interferes with, or is likely to interfere with, the use of electricity by other customers for any of the following reasons, or where he/she interferes, or is likely to interfere with, the electric installations of Korea, he/she shall install the adjustment devices or protective devices at the place of electric use, which he/she recognizes at the expense of the customer, and if particularly necessary,

1. Where the load of each party significantly loses a sentence;

2. Where the voltage or the frequencies are remarkably changed;

Article 47 (Suspension of Supply or Restriction on Use of Supply) (1) Electric Power may inevitably suspend the supply of electricity or restrict the use of electricity in any of the following cases:

1. Where the Minister of Trade, Industry and Energy instructs under statutes;

2. Where it is inevitable due to the adjustment of electricity supply and demand;

3. Where trouble occurs or is likely to occur in the electric installations of one electric wave;

4. Where it is inevitable due to construction works for repairing, altering, etc. the electric installations of Korea;

5.A severe imbalance or change in voltage and radio frequencies occurs.
