Defendant
A shall be punished by a fine of KRW 5 million, by a fine of KRW 4 million, by a fine of KRW 3 million, and by a fine of KRW 3 million.
Reasons
Punishment of the crime
1. Joint crimes committed by Defendants A, B, and C: Defendant A related to the embezzlement of F Residents’ Compensation Fund from around 1997 to around 1999; from around 201 to around 2013, Defendant A served as the head of H fishing village located in G and located in G; from around 2013 to around 2013, Defendant B was elected as the head of the H fishing village fraternity and served as the head of the current H fishing village fraternity; Defendant B was elected as the head of the fishing village fraternity around June 20, 2014; and Defendant C was engaged in the duties of executive secretary of the fishing village fraternity from around June 2014 to the fishing village fraternity.
From April 2015, the Defendants had continuously promoted the compensation for residents' damage by organizing the "K residents, fishermen (L and M) emergency response committee", which are the co-chairpersons of Defendant A and Defendant B as the co-chairpersons of the Emergency response committee around September 2015.
The Defendants mobilized residents from September 2015 to December 2015, the J apartment construction site neighboring the J apartment site located in the IS from September 2015 to the J apartment construction site suffered damage, such as construction noise, and held meetings against F over 20 times. On December 30 of the same year, the Defendants agreed with the LM and the Compensation Fund for damage, and the Defendants cannot file any additional civil, criminal, administrative, or administrative claims or objections with F for any reason with respect to this Agreement and the Construction Project.
"A civil petition agreement" with the content is prepared, and K residents (LM), fishermen, commercial tenants, etc. receive a total of KRW 850 million, including KRW 60 million under the name of the village joint development fund, and KRW 250 million under the name of the village joint development fund. On December 29, 2005, the amount of KRW 850,000,000,000 was received and kept as the head of the Chang-gu YN under the name of the Chang-gu YN.
Defendants, in collusion, are fishing village fraternities around 15:00 on December 31, 2015.
